Learn How To Get Paid Direct When A New DSS Tenant Moves Into Your Property

In April 2011 the Housing Benefit Regulations were amended to pay landlord directs where it would help a tenant to secure a new tenancy or to remain in their current tenancy.
To make sure you get your rent paid direct make you will need to do the following:
  1. Make sure your DSS tenant signs the relevant section stating that he or she would like you to be paid direct when completing their Housing Benefit form.
    Make sure you double check this before your tenant send’s this off to the local Housing Benefit office in the council

  2. You will need to include a letter with Housing Benefit form requesting for the direct payment.
    You will need to tell them what your bank details are and you will also need to quote the relevant regulations which highlight why you should be paid.

  3. You will also need to add an additional ground to your tenancy agreement.
    This ground should state that it is a condition of the tenancy that if the tenant is in receipt of Housing Benefit the landlord MUST be paid directly by the local authority acting for the claim.

    If the tenant gets paid the Housing Benefit directly instead of you, either during the initial fixed term or during a periodic term, then eviction proceedings will commence

If your DSS tenant has fallen behind with their rent payments by 8 weeks or more you can be asked to be paid direct by your tenant’s local Housing Benefit office.

Most landlords are unaware of this part of the Housing Benefit general rules and regulations.

  1. Your DSS tenant will need to be in arrears of 8 weeks or more.
